The Federal Motor Carrier Safety Administration sets minimum fire extinguisher requirements for commercial motor vehicles under 49 CFR § 393.95. Requirements vary by vehicle type, gross vehicle weight rating, and cargo classification. Here's what applies to each.

Mounting and Accessibility Requirements
Secure Mounting Required
The extinguisher must be mounted in a bracket that holds it securely against road vibration. An extinguisher rolling loose in the cab does not satisfy the requirement — it must be in a proper vehicle bracket.
Driver Accessibility
The unit must be readily accessible to the driver from their seated position or reachable without leaving the vehicle in an emergency. Placement behind cargo or in locked storage does not comply.
Maintained and Serviceable
The extinguisher must be fully charged and in proper working condition. An expired unit, a discharged unit, or a unit with a broken tamper seal is a violation even if it's the correct size and rating.
What a DOT Roadside Inspector Checks
Correct Size and Rating
Is the unit the minimum required size for the vehicle type? Does it carry the minimum UL rating? A 2.5 lb unit on a hazmat vehicle is an automatic violation.
Proper Mounting
Is the extinguisher in a secure bracket? Can it be accessed quickly by the driver? An unsecured or inaccessible extinguisher fails inspection regardless of condition.
Gauge in Operable Range
The pressure gauge must read in the green zone. A unit reading low or overcharged is out of service. Inspectors check the gauge on the spot.
Tamper Seal Intact
The pull pin must have an unbroken tamper seal. A missing or broken seal indicates the unit may have been discharged and not recharged — an automatic out-of-service condition.
No Visible Damage
Dents, corrosion, damaged hose, or missing nozzle are all citable defects. Road-mounted extinguishers take a beating — regular inspection catches these before a DOT inspector does.
Current Service Tag
While FMCSA doesn't mandate an annual inspection tag the way NFPA 10 does for fixed installations, inspectors look for evidence the unit is maintained. A current tag from a licensed technician protects you.
